Terms of Service for Dating App 

Introduction

This document outlines the terms and conditions (“Terms”) that govern the use of the Dating App (“Service”) provided by Dattico. By using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. 

Eligibility

The Service is intended for use by individuals who are 18 years of age or older. By using the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement. 

Account Creation 

To use the Service, you must create an account and provide accurate, complete, and up-to-date information about yourself. You are solely responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to immediately notify Dattico of any unauthorized use of your account. 

User Content 

The Service allows you to upload and share content, including but not limited to text, photos, and videos (“User Content”). You retain all rights to your User Content and are solely responsible for its accuracy and legality. You grant Dattico a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, and display your User Content in connection with the Service. 

Proprietary Rights 

The Service and its content, including but not limited to text, software, scripts, graphics, photos, sounds, music, videos, interactive features, and the like (“Content”), are protected by copyright, trademark, and other laws of Belgium and foreign countries. Dattico owns or licenses the Content and the Service, and retains all rights not expressly granted to you. 

Conduct

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of or restrict or inhibit the use and enjoyment of the Service by, any third party. You agree not to use the Service to upload, post, transmit, or otherwise make available any content that shows nudity or is illegal, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable. 

Termination

Dating App, Inc. may, in its sole discretion, at any time terminate or suspend all or a portion of the Service, or your use of all or a portion of the Service, with or without notice and with or without cause. 

Disclaimer of Warranties 

The Service is provided on an “as is” and “as available” basis. Dattico makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service. 

Limitation of Liability 

In no event shall Dattico be liable for any damages of any kind arising from the use of the Service, including but not limited to direct, indirect, incidental, punitive, and consequential damages. 

Indemnification

You agree to indemnify, defend, and hold harmless Dattico, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising or resulting from your breach of these Terms or your use of the Service. 

Governing Law 

These Terms shall be governed by and construed in accordance with the laws of the Belgian Federal State, without giving effect to its conflict of laws provisions. You agree to submit to the exclusive jurisdiction of the courts located in Brussels to resolve any dispute arising out of these Terms or the Service. If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and Dattico with respect to the use of the Service.  

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the Service or these Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.
